Terms and Conditions

These Terms and Conditions explain the rules for using the OmazDigital website and how website information relates to a separate client-service agreement.

Last updated:

Agreement and scope of these terms

By using omazdigital.com, you agree to these Terms and Conditions to the extent permitted by applicable law. If you do not agree, stop using the website. You must have the legal capacity to enter an agreement, or use the website with the appropriate authorization.

OmazDigital provides web development, design and related digital services. This website introduces those services and publishes general guidance. Visiting a page, requesting information or sending an enquiry does not itself create a paid project, guarantee availability or reserve a delivery date.

Project agreements and responsibilities

The deliverables, fees, payment schedule, review process and responsibilities for a client project should be set out in a separately accepted proposal or service agreement. That agreement governs the specific project if it conflicts with these general website terms, subject to mandatory legal rights.

A project scope should identify required pages, features, integrations, content responsibilities, access requirements and acceptance criteria. Client feedback, accurate information, licensed assets and timely approvals may be necessary to progress the work. Changes outside an agreed scope require a separate discussion of their effect on fees, priorities and delivery.

Ongoing maintenance, hosting, domain renewals, content updates and third-party subscriptions are not automatically included merely because they appear among our available services. Their inclusion and duration depend on the project agreement. Review the services page for the areas of work available.

Lawful and responsible website use

You agree to use the website for lawful purposes and not to interfere with its security or operation. Do not attempt unauthorized access, distribute malware, bypass access controls, impersonate another person or use forms for spam, harassment or unlawful material. Do not deliberately submit information you know is misleading.

Any automated access must respect applicable law, access restrictions and the operation of the service. Permission to browse public material does not grant permission to overload systems, obtain private records or republish protected material at scale. We may restrict abusive access where lawful and proportionate.

Provide accurate contact details when requesting a response. Avoid including passwords or sensitive payment information in an enquiry. If technical access is needed for a project, agree on a suitable secure process rather than sending credentials through a public form.

Intellectual property and permitted references

Unless otherwise identified, the original text, design and other materials created for this website belong to OmazDigital or are used under an applicable permission or licence. Third-party names, trademarks, screenshots and materials remain the property of their respective owners. A portfolio reference does not transfer ownership of a client’s brand or website.

You may read the site and link to publicly available pages in a lawful, non-misleading manner. Copying, selling or republishing substantial portions of protected content requires permission or an applicable legal exception. Do not imply that OmazDigital endorses another business without authorization.

Ownership of project deliverables, source files, licences and reusable components is determined by the relevant project agreement. A platform, font, plugin, stock asset or other third-party component may remain subject to its original licence even when used within a client project.

Payments, changes and cancellation

Fees, deposits, invoicing dates and accepted payment arrangements are specified in each project agreement. Do not rely on a general website statement as a final quote. Third-party costs should be identified separately where they are not included in the agreed fee.

Any late-payment charges, suspension rights, refund conditions or cancellation charges must be supported by the relevant agreement and applicable law; these terms do not introduce an unspecified automatic penalty. If a project needs to pause or change, contact us to review completed work, outstanding commitments and the applicable agreement.

Nothing in these terms removes non-waivable consumer rights, statutory remedies or any other rights that applicable law gives you. Where such rights apply, they take precedence over an inconsistent provision.

Third-party websites, tools and advertising

The site may link to documentation, client websites or other independent resources. We do not control their availability, content, privacy practices or terms. A link is provided for context and is not a blanket endorsement. Evaluate external information and any purchase independently.

If advertising, sponsored content or affiliate links are introduced, relevant commercial relationships should be identified clearly. An advertisement is not a recommendation or a guarantee of the advertiser’s product. Visitors must not be asked to click advertisements to support the site or be misled into mistaking ads for navigation.

Our Privacy Policy explains information handling and conditional advertising-cookie disclosures. Browsing terms do not replace any separate consent required for optional advertising or marketing.

Information, availability and results

We aim to present useful and accurate information, but content can become outdated and may contain errors. General articles are not individualized legal, financial or other regulated professional advice. Verify important information with the relevant provider or qualified adviser before acting.

Website availability can be affected by maintenance, infrastructure, security incidents or events outside our control. No agency can guarantee a particular search ranking, plugin score, traffic level, revenue figure or AdSense approval. Outcomes depend on the website, market, offer, audience and third-party decisions as well as implementation.

Liability and claims

To the extent permitted by law, OmazDigital is not responsible for indirect or consequential loss arising from use of this informational website. Any limitation is subject to mandatory law and does not exclude liability that cannot lawfully be excluded, including applicable statutory rights.

Responsibility for paid services, including any agreed liability limits, is addressed in the project agreement. You remain responsible for unlawful material you submit and for misuse of the website. Claims or reimbursement obligations arising from that conduct remain subject to applicable law; these terms do not impose unlimited liability for ordinary, lawful browsing.

Governing law, questions and changes

Applicable law determines the rights and remedies relating to website use. A project agreement may specify a governing law and dispute procedure for that engagement, without removing mandatory protections. These website terms do not name an unverified business-registration jurisdiction or require visitors to use a court in an unspecified country.

If an issue arises, contact [email protected] with the relevant page or project reference and a clear description so we can first try to understand and address it. The contact page provides another way to reach us.

We may revise these Terms and Conditions as the website or services change. The date above identifies the current version. Revisions do not automatically rewrite an existing signed project agreement; any necessary project change must follow that agreement’s process.
